Tik Tok star Bryce Hall has been sued for assault and battery by a restaurant co-owner he was filmed brawling with last year.

The incident took place in October at the Mexican restaurant Cinco in Los Angeles and footage obtained by TMZ showed Hall, 21, and another man crashing into a stool as their fight skidded across the outdoor patio.

Now co-owner Hernan Fernando has alleged that he suffered ‘a broken hand, a bruised face, pain from being punched in the ribs, and neck and back injuries,’ People reported Tuesday citing court documents.

DailyMail.com has reached out to a representative for Hall for comment. 

In addition to the assault and battery allegations Fernando is suing for intentional infliction of emotional distress.

The restaurateur – who is originally from Mexico – also claims race played a role and that Hall referred to him as ‘the Mexican’ and a ‘wetback.’

Fernando claims that Hall and his friends were vaping at their table – which is illegal at Los Angeles restaurants – and would not cease doing so when told to.

As a result, the plaintiff claims, Hall and his party were asked to leave and to remain outside the restaurant while his credit card was run.

Fernando’s court documents allege that in ‘an unconscionable COVID-19 threat during a worldwide airborne pandemic,’ the Tik Tok star blew vape steam in his face.

The restaurant co-owner claims that his attempts to remove Hall and his friends from the restaurant caused one member of the party to go ‘berserk.’

In his lawsuit he alleges that both Hall and his friend began ‘began physically attacking and punching Mr. Fernando’ at this point.

Fernando claims Hall spent 30 seconds ‘choking him from behind with his arm around Mr. Fernando’s neck,’ while insisting that he – Fernando – did not punch anyone.

Last October in the immediate aftermath of the brawl Bryce claimed to TMZ that he was perfectly polite about being told to exit the restaurant for vaping.

He alleged however that while waiting outside the restaurant he had to request the return of his credit card 10 times, whereupon he claims a manager said: ‘No, get the f*** off the property.’

Furthermore Hall alleged that the larger fight broke out only when the manager attempted to bodily drag him from the premises.

The social media star admitted to putting the manager in a headlock, but alleges that he only did so to protect one of his friends.

Meanwhile he alleged that over the course of the brawl he himself had to endure a kick in the groin from the manager.

Law enforcement were called to the scene of the brawl but TMZ reported that Hall and his party were gone before they reached Cinco.

Hall’s bout of legal trouble comes about a month after it emerged that he has broken up with his fellow Tik Tok star Addison Rae.
